International Investment Law and Climate Change

Seminar synopsis:
Climate change presents profound challenges for the investment treaty regime. Fossil fuel investors are some of the main beneficiaries of investment treaty arbitration and criticisms are mounting that modern investment law is unaligned with the objectives of the Paris Agreement. For instance, many governments recently decided to leave the Energy Charter Treaty on climate grounds, which raises important questions about the remaining global network of +2500 treaties with similar investment provisions. This seminar will assess the tensions between climate change and investment law and highlight the evolving policy landscape in efforts to align the investment treaty regime with the Paris Agreement.

Lauge Poulsen is Professor of International Relations & Law at UCL and Chair of OECD’s inter-governmental work programme on climate change and investment law.
